DECLARATION OF AWARENESS OF ASSUMPTION OF RISK AND RELEASE OF LIABILITY

By registering for the Brevetto Duomo Stelvio Challenge (hereinafter Brevetto) organized by Team 100.1 SSD a RL (hereinafter Organizer) I self-certify and declare, assuming every civil and penal responsibility in case of a reckless, irresponsible and/or mendacious declaration:

to have read all the documentation relating to the Brevetto published on the web page …—- and to have carefully evaluated every detail in particular regarding the route, the difficulties, the dangers, as well as the weather and road conditions which could be difficult, the condition of being in a self-supporting activity related to the Brevetto (hereinafter referred as activity), the absence of any technical support and assistance during the route;
to be in possession of a medical certificate to practice competitive sport of cycling (NO triathlon, NO athletics or other disciplines) and to be currently in excellent physical condition and without any apparent contraindications and such as to allow the completion of the Activity in total safety regarding your body;
to be fully aware of any risks and dangers directly and indirectly connected to practice the Activity, in particular, for example: crashes, accidents, crossing of wild animals, adverse weather conditions, orientation problems, illness, damaged or interrupted road surfaces;
to be fully aware that the participation in the Activity is voluntary, like every action performed during the practice of the Activity itself, therefore he assumes full personal responsibility for the consequences that may occur from the aforementioned actions, both civilly and penally, towards itself and towards third parties;
to recognize and acknowledge that no contractual or non-contractual liability can be recognized on the Organizer for pecuniary or non-pecuniary damages suffered personally by the undersigned or caused to third parties during the Activity;
to release and hold the Organizer harmless from any liability for any pecuniary or non-pecuniary damage, including any physical injuries suffered by the undersigned or by third parties, including damage to the vehicle and equipment used for the route, which may occur for any reason, also to third parties;
to be obliged to wear a rigid and regularly approved protective helmet during the entire journey and the time for completing the Activity, as well as to use the white front and rear red lights well fixed on the bicycle and clearly visible and, also, to obligatorily wear the reflective stripes;

to recognize and acknowledge that the only legal obligation of the Organizer towards me is to certify the result declared by the undersigned in order to receive the Brevetto which consists in nomination of my name in the roll of honor and receive the medal of finisher;

to oblige me to fully comply with the traffic rules and the laws in force and to respect the regulations for the use and of the pedestrian and cycle path of the Comunità Montana Valtellina e di Sondrio;
to renounce taking any legal action of any kind against the Organizer, recognizing that it is a non-professional organization acting for recreational purposes without its requirements (ex art. 1174 of the Civil Code);
for any dispute arising from the Activity relating to the Brevetto Duomo-Stelvio Challenge or connected to the same, the Court of Milan will have exclusive jurisdiction

RELATING TO THE REGULATIONS OF THE CURRENT PRIVACY RULES,

to be informed that the personal data transmitted will be kept by the Organizer also on IT media and will be processed in full compliance with the security measures and protection of my confidentiality.
